Overview

Ellis Funk, P.C. (“EF “) respects the privacy of its website visitors.  This Privacy Policy describes the information EF collects from you and how it uses that information when you use the EF website. By accessing or using the EF website, you acknowledge that you have read, understood and accept the terms of this Privacy Policy.  This Privacy Policy is effective as of January 6, 2024.

Information You Voluntarily Provide EF

You may use the EF website without providing EF with any information about you.  EF only collects personally identifiable information that you voluntarily provide, such as when you make a payment through the EF website.  Examples of such personally identifiable information that you provide to us may include, among other information, your name, physical address, email address, phone number, credit card number, credit card security number and website username.

Other Information EF Collects

When you visit the EF website, we may automatically collect some information about your visit using cookies, log analysis software and other aggregate tracking technologies.  This includes information relating to whether you open an email that is sent to you by EF or whether you visit the EF website.

You may modify your browser settings to control the collection of cookies.  However, if you refuse to accept cookies, you may not be able to access some pages or use some of the functions of the EF website. Some EF cookie files remain on your computer’s hard drive unless and until you manually delete the file.

How EF Uses the Information It Collects

EF will not sell, exchange or otherwise distribute your personally identifiable information without your consent, except to the extent required by law, in accordance with your instructions, or as identified in this Privacy Policy.

EF may use your information, including personally identifiable information, for business purposes including, without limitation, the following:

  • To improve the quality of your EF website visit.
  • To bill your credit card when you elect to pay an invoice online or to credit your credit card if EF issues you a refund.

Also, EF may use your information, including personally identifiable information, as follows:

  • EF may contract with other companies and individuals to perform functions or services on its behalf, such as hosting and maintaining the EF website, payment processing, database storage and management, sending email messages and informational newsletters and administering surveys. These service providers may have access to your personally identifiable information, such as your email address, needed to perform their functions, but are restricted from using it for purposes other than providing services for EF.
  • EF has the right to disclose any information about you, including personally identifiable information, or your use of the EF website, without your prior permission if EF has a good faith belief that such action is necessary to: (a) protect and defend the rights, property or safety of EF or its shareholders, principals, employees, agents, other users of the site, or the public; (b) enforce the Terms of Use for the EF website; or (c) respond to claims that any content violates the rights of third parties or is otherwise unlawful. EF may also disclose information, including your personally identifiable information, as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request.
  • EF may share any information you submit to EF when EF has your consent to do so, or when EF needs to share the information to provide the information or service you requested.
  • EF may use your information to monitor how visitors are using our site.
  • EF may use your information to uncover and diagnose problems with the EF website and servers and for day-to-day system administration needs.

Updating Your Information; Opting Out

Visitors who would like to correct, update or delete any information, including personally identifiable information, may contact EF with a request to do so at jjamieson@ellisfunk.com. EF will respond to any request to update or modify any information within a reasonable period.  If you request the deletion or modification of your personal information maintained by EF, such information may be retained for a period in EF’s backup systems as a precaution against system failures. Some information may be retained for longer periods as required by law, contract or auditing requirements.

Mobile Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent: this information will not be shared with any third parties.

Security

EF follows generally accepted industry standards to protect your personally identifiable information, both during transmission and once EF receives it, including the use of firewalls and other Internet security measures.  However, no method of transmission over the Internet or method of electronic storage is 100% secure, and EF cannot guarantee its absolute security.  Accordingly, EF expressly disclaims any such obligation.

EF does not store on its servers, or keep any in-office record of, any credit card information you provide EF through the EF website.  EF utilizes a third-party service for credit card payment processing and your credit card information is stored on the third party service’s servers.  EF’s credit card processor follows generally accepted industry standards to protect your credit card information, both during transmission and once the processor receives it.  However, no method of security is absolute, and EF cannot guarantee the absolute security of your credit card information.  Accordingly, EF expressly disclaims any such obligation.

Updates to This Privacy Policy

EF reserves the right to change, alter or modify this Privacy Policy for any reason at any time without notice to you.  When EF does so, all changes, alterations or modifications to this Privacy Policy will be posted on the EF website and will be effective immediately.  If you are a regular visitor to this site, EF recommends that you check this Privacy Policy on a regular basis.

EF Policy for Users of the BRAWW Website Under Age 18

The EF website is not intended for use by individuals under 18 years of age.  Users under the age of 18 should get the permission of a parent or guardian to use the EF website.  EF will not knowingly collect or maintain personal information from anyone under the age of 18.

External Links

The EF website may include links to other websites whose privacy policies EF does not control. Once you leave the EF website, use of any information you provide is governed by the Privacy Policy of the operator of the site you are visiting.
